Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Card Phantom (“Card Phantom”, “we”, “us”, or “our”) governing your access to and use of our website, editor, and related services, including the creation of AI-generated trading-card artwork and the manufacture and shipment of physical printed cards (collectively, the “Service”). By accessing or using the Service, or by clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Service.
Who we are. The Service is provided by Card Phantom, based in Ontario, Canada. You can reach us at support@cardphantom.com. Before you complete a purchase, we present these Terms and your order details and give you an opportunity to review, accept or decline, and correct any errors before payment.
1. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service — including to create cards, upload photos, and make purchases. The Service is not directed to children or teenagers, and you may not use it if you are under 18. Photos that depict a minor may only be uploaded by that minor’s parent or legal guardian, or with that guardian’s explicit consent.
You are responsible for all activity under your account and for keeping your login credentials secure. We use a third-party identity provider (Google Firebase Authentication) to sign you in; your use of that sign-in is also subject to Google’s terms.
2. Your content & the photos you upload
You may upload photographs and other materials (“Inputs”) to generate card artwork. You retain ownership of your Inputs. You grant us a worldwide, non-exclusive licence to host, process, reproduce, and adapt your Inputs solely to provide the Service — including sending them to our AI provider to generate your card and to our print partner to manufacture your order.
You represent and warrant that, for every photo you upload:
- you own it or have all rights and permissions necessary to use it;
- you have the consent of every identifiable person shown in it to create a card from their image; and
- if the photo shows a minor, you are that minor’s parent or legal guardian, or have that guardian’s explicit consent.
You must not upload content that is unlawful, infringing, defamatory, hateful, sexually explicit, depicts a minor in any sexualized way, or that infringes the intellectual property, privacy, or publicity rights of others — including images of celebrities or public figures without authorization, or content protected by third-party trademarks or copyrights. We may remove content or suspend accounts that violate these Terms, and we may decline to produce any order at our discretion.
3. AI-generated output
The Service uses generative AI to transform your photo into card artwork (“Output”). Because of the nature of AI, Output may be inaccurate, may not perfectly resemble the subject, and is not guaranteed to be unique — other users may receive similar results. Subject to your compliance with these Terms and your having the necessary rights in your Inputs, you may use the Output you generate for personal and lawful commercial purposes. You are solely responsible for reviewing your Output before placing an order.
Output is for entertainment and custom-artwork purposes only. Any text generated for a card (names, stats, descriptions, and similar) is creative content and must not be relied upon as factual, professional, medical, or legal advice.
4. Tokens, prices & payment
Card generation is metered with tokens. Tokens are a prepaid digital credit, are sold in packs, and have no cash value. Token purchases are final and non-refundable, except where required by applicable law. Unused tokens remain in your wallet. We may change token pricing and the token cost of features at any time; changes apply going forward.
Full price before you pay. Before you place an order we show the product price, applicable taxes, shipping charges, and any other mandatory charges we collect, so the total you pay is clear at checkout. Import duties, customs fees, and carrier brokerage fees may be charged separately by third parties and are your responsibility. Prices are shown in the currency indicated at checkout (Canadian dollars unless stated otherwise). Payments are processed by Stripe; by purchasing you agree to Stripe’s terms and privacy policy. We do not store your full card details.
Fraud & chargebacks. We may cancel, hold, or refuse any order that we reasonably believe is fraudulent, abusive, or in breach of these Terms.
5. Physical cards: production, shipping & returns
Each card is a custom, made-to-order product manufactured from your generated artwork. Production begins after payment, and orders generally cannot be changed or cancelled once production has started. Cards are printed by our manufacturing partner and shipped internationally through third-party logistics providers. Delivery times are estimates, not guarantees, and you are the importer of record responsible for any customs duties or taxes in your destination country.
Because the cards are personalized, all sales are final. However, if your order arrives defective, misprinted, or damaged in transit, contact us within 14 days of delivery with photos and we will, at our option, reprint or refund the affected item. This does not affect any non-waivable rights you may have under the Ontario Consumer Protection Act or other applicable consumer law.
Quality variation & expected characteristics. Each card is individually produced with foil/holographic finishes, so some variation — between one card and another, and between the on-screen preview and the printed result — is normal and inherent to the product, and is not a defect. In particular:
- printed colours may differ from your screen — screens use RGB and vary by device and calibration, while printing uses CMYK — so slight colour shifts are expected;
- the holographic/foil effect (including segmented, full-card, textured, and gauze finishes) is decorative, and its exact pattern, coverage, sparkle, intensity, and appearance change with lighting and viewing angle and vary from card to card;
- minor differences in cutting, centering, and trim within normal manufacturing tolerance may occur;
- print sharpness depends on the resolution and quality of the AI-generated image you approved, so any softness, artifacts, or upscaling present in your approved file will appear on the card; and
- cards are novelty custom collectibles, not official or licensed trading cards, and may differ in card stock, thickness, gloss, and finish from mass-produced cards.
These characteristics are part of a handmade, made-to-order product and are not grounds for a refund or reprint. Our reprint-or-refund commitment above applies only to items that arrive genuinely defective, misprinted, or damaged in transit — not to subjective dissatisfaction with normal variation or with the AI artwork you approved.
You approve what we print. Because you create your own card, you are responsible for reviewing the spelling, names, stats, image quality, and cropping before checkout. We print the card as you approved it and are not responsible for mistakes in your approved design — only for a delivered product that differs materially from the file you approved.
Production & delivery times. Estimated production and delivery windows are shown at checkout or in your order confirmation. If we cannot ship within the stated window, we will contact you with an updated estimate or offer cancellation where required by applicable law.
6. Intellectual property & trademark notice
The Service, including our software, designs, templates, and branding, is owned by Card Phantom and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to use the Service for its intended purpose. You may not copy, scrape, reverse-engineer, or resell any part of the Service.
Trademark notice. Card Phantom is an independent product and is not affiliated with, endorsed by, or sponsored by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company, or any other trading-card publisher. “Pokémon” and all related names, marks, and card designs are the property of their respective owners. Card Phantom produces original, user-directed artwork and a generic collectible-card format; you may not use the Service to reproduce or imitate any third party’s copyrighted characters, artwork, logos, or trade dress.
7. Acceptable use
You agree not to: use the Service for unlawful purposes; upload prohibited content (Section 2); interfere with or attempt to breach the security of the Service; scrape or use automated means to access it; resell or sublicense access; or use it to build a competing product. We may suspend or terminate access for violations.
Changes to the Service. We may add, modify, suspend, or discontinue features, token packages, templates, card styles, or the AI models we use at any time, with or without notice.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Output or printed results will meet your expectations.
9. Limitation of liability
To the fullest extent permitted by law, Card Phantom will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) CAD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You will indemnify and hold harmless Card Phantom from any claims, damages, and expenses (including reasonable legal fees) arising from your Inputs, your use of the Service, your violation of these Terms, or your infringement of any third party’s rights — including any claim that a photo you uploaded lacked the necessary rights or consents.
11. Termination
We may suspend or terminate your access at any time for breach of these Terms or as required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
12. Governing law & disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.
